It's basic contract law the people in question or suing because they were paid Live Gold members so this throws out Silver members that weren't paying anything. So going by this basis a contract is formed for services to be rendered by Microsoft to the end user through Xbox Live. The user violated a term of said contract, these dumb SOB's should be lucky Microsoft isn't suing them for break of contract. The contract stated that they would not be refunded for services expect in certain circumstances as outline. Getting your dumb ass banned for violating the TOS, is not one of those reasons. Maybe people should read contracts before they agree to them, might keep these sorts of lawsuits from waiting a bunch of time and tax dollars.

Probably has a lot to to with advertising revenue. Youtube has never been a very profitable venture. If the API isn't advertisement friendly aside from the annoying in bottom of window ads that pop up on the regular interfaces, it may simply boil down to money. I don't recall seeing adds on Youtube streams on the iPhone. I have never used a Popcorn device so I can't speak for the presence or lack of ads on those devices. However, if devices that could bypass the majority of the ads that Google makes money got too popular and affected the revenue stream or increased costs by going the API route then Google would be forced to respond. I'm not saying its right, I'm not saying it a good PR move, but it's a business decision and Google is going to have to deal with the fallout.

Nov 17th 2009 12:08PM The lack of gigabit ethernet is certainly annoying, just like the lack of it on some wireless N access points. Why bother having a nice fast device if you are going to gimp it with 10/100Mbps ethernet. 10MBps doesn't cut it for data traffic for most anything anymore.
